Terms of use
Effective October 15, 2026
These terms are an agreement between you and Jay Aparo, the individual developer of Yardbird ("Yardbird", "we", "us"). They cover the Yardbird iPhone app, its companion Apple Watch app, and yardbirdapp.com. Yardbird plans to launch first on iOS and watchOS. An Android version is in development but is not yet available. By using Yardbird, you agree to them. If you don't agree, please don't use the app.
1. Using Yardbird
You must be at least 13 to use Yardbird. If you're under the age of majority where you live, a parent or guardian must agree to these terms. You're responsible for your account and for keeping your sign-in secure.
2. Beta versions
Test versions provided through TestFlight are unfinished and may have bugs, change, or stop working. Please don't rely on them for anything important, and send feedback to support@yardbirdapp.com. Apple's TestFlight terms also apply.
3. Distances and golf information are estimates
Scores, handicap calculations and game standings depend on information entered by players and can be wrong. GPS distances, mapping, weather recommendations and shot tracing are planned for later releases, not the initial release. If offered, any distances or sensor-based estimates may be inaccurate. Use your own judgment, follow the course's rules and signs, and watch for other golfers, carts and hazards. Don't use the app while driving a cart or car.
Under the Rules of Golf, some features (such as slope or "plays like" distances, club recommendations and measured wind) are not allowed during competitions. It's your responsibility to follow the rules of any competition you play in.
4. Games are for fun, never money
Round games in Yardbird (such as Skins and Nassau) and any challenges are scored in points for fun. Yardbird does not accept, hold, track or settle money, and you may not use Yardbird to organize or record gambling.
5. Future Yardbird subscriptions
- Yardbird is in development. We may offer an optional Basic or other subscription through the App Store when the paid features are ready. No subscription purchase is offered on this website. The confirmed price, renewal terms and included features will be displayed in the app before purchase.
- If different paid tiers become available, upgrades and downgrades will follow the App Store subscription rules in effect at that time.
- If a trial is offered, the app will show its terms and what happens after the trial. Manage or cancel any subscription through your Apple account before its renewal date to avoid future charges.
- You can cancel anytime in your Apple account settings (Settings → your name → Subscriptions). Canceling stops future renewals; you keep your plan until the end of the period you paid for.
- Payments, refunds and billing are handled by Apple under Apple's terms. We can't issue refunds directly.
- We may change prices or features of Basic or Pro. Price changes follow Apple's rules, including notice and, where required, your consent.
6. Referral program
Invitations and referral rewards may be introduced as the app evolves. The terms, eligibility, and any reward will be described in the app when a program is active. There is no guaranteed referral reward simply for requesting beta access.
7. Your content and group rounds
You own the rounds, scores, clips and other content you add. You give us permission to store and show it so the app works, for example showing your scores to the other players in a round you join. Don't post anything unlawful, or anything that harasses others or infringes someone else's rights.
8. Acceptable use
Don't misuse Yardbird: no hacking, scraping, reverse engineering, interfering with the service, creating fake accounts, or using it to break the law or harm others. We may suspend accounts that do.
9. Our app and course data
Yardbird, its design and code belong to us. We grant you a personal, non-transferable license to use the app as allowed by these terms and Apple's standard license agreement. If course-map features are introduced, applicable map-data credits and terms will be shown with those features. Equipment brand names shown in the app (for example in My bag) are trademarks of their owners, used only to identify your equipment. Yardbird isn't affiliated with or endorsed by those brands.
10. Disclaimers
Yardbird is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of distances or data.
11. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for injuries or losses from relying on scores or other information in the app. Our total liability for any claim is limited to the amount you paid for Yardbird in the 12 months before the claim, or $50, whichever is more. Some places don't allow these limits, so they may not apply to you.
12. Ending your use
You can stop using Yardbird and delete your account anytime in the app (Profile → Delete account). Deleting your account permanently deletes your data as described in our Privacy Policy and can't be undone. It doesn't cancel a subscription; cancel that in your Apple account settings. We may suspend or end access if you break these terms. Sections 3, 4, 9, 10, 11 and 13 continue to apply after that.
13. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New Jersey, unless the law where you live gives you the right to bring it locally.
14. Changes
We may update these terms. We'll change the date at the top and, for significant changes, tell you in the app. If you keep using Yardbird after changes take effect, you accept the new terms.
15. Apple
These terms are between you and us, not Apple. Apple isn't responsible for Yardbird or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
